We provide two categories of non-regulated business services under the trading name FINSTACKD:

1.1 Payment Services

We provide two broad categories of non-regulated business services under the trading name FINSTACKD. These services are offered to business clients under separate written agreements, and some may involve the use of third-party platforms or providers. The following list is representative but not exhaustive.

• Merchant Account: Support with preparing, submitting, and managing merchant account applications via acquiring partners. Finstackd acts as an intermediary and does not guarantee approval.
• Payment Gateway: Integration and routing support using third-party orchestration platforms.
• Dispute Management: Access to early-warning alert systems (e.g. Ethoca, Verifi), representment services, and dispute handling tools.
• Bank Account: Referral and guidance for business bank account setup with financial institutions.

1.2 Finance Back-Office Support

We assist online businesses with operational finance functions and back-office workflows, including:

• Company Incorporation: Coordination of company formation and registration procedures in relevant jurisdictions.
• Bookkeeping and Financial Record Management: Ongoing management and reconciliation of financial data using cloud-based accounting systems.
• Financial Reporting: Preparation of internal financial reports and dashboards.
• Credit Management: Support with accounts receivable processes, including invoice follow-up and collection assistance.
• Consulting: Strategic and operational advice on financial workflows, reporting architecture, PSP onboarding, and multi-entity coordination.

2. No Regulated Services or Advice

We are a team of seasoned professionals with extensive experience in payments, finance operations, and business support. However, we do not provide any services that require authorisation or regulation by the Financial Conduct Authority (FCA).

Specifically, we do not offer financial advice, investment services, accounting audits, or any other activities regulated under the UK Financial Services and Markets Act 2000. We are not FCA-authorised, and we are not chartered accountants.

Our services are operational and advisory in nature, designed to support business workflows and infrastructure. You should consult a licensed financial advisor or accountant for any regulated matters or formal accounting obligations.

3. Client Responsibilities

Clients remain responsible for the accuracy and legality of the data they provide and the compliance of their own operations. You must ensure that your use of our services complies with applicable laws and regulations.

4. Use of Third-Party Services

We may rely on third-party tools or platforms (e.g., accounting software, payment processors) to deliver our services. You acknowledge that use of these tools may be subject to the terms and conditions of those providers.

We will treat your business and financial data as confidential and implement reasonable measures to protect it. We may disclose information if legally required or with your written consent.

6. Fees and Payment

Fees for our services will be agreed upon in writing with each client. Invoices are payable according to the terms specified in each agreement. Late payments may incur penalties or service suspension.

7. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, or consequential losses arising from your use of our services. Our total liability shall not exceed the amount paid for the specific service giving rise to the claim.

8. No Guarantee of Outcomes

While Finstackd strives to support clients in securing merchant accounts, managing disputes, and improving financial operations, we do not guarantee any specific outcomes, including but not limited to account approvals, alerts, dispute win rates, financial results, or uninterrupted service. All engagements are subject to independent approval by third-party service providers, and Finstackd assumes no responsibility for their decisions or performance.

9. Termination

Either party may terminate services by giving written notice in accordance with any contract terms. We reserve the right to suspend or terminate access to our services if you breach these Terms.

10. Intellectual Property

All content on our website, including text, branding, and design, is the property of DGTLPAY LTD or its licensors. You may not reproduce or distribute any part without written permission.

11. Third-Party Relationships and Commissions

In the course of delivering our services, we may refer you to or facilitate access to third-party service providers such as payment processors, financial software platforms, or banking institutions.

You acknowledge and agree that we may receive referral fees, commissions, or other forms of compensation from such third parties as part of these relationships. These arrangements do not affect the objectivity of our recommendations, and we will always aim to act in the best interests of our clients.

13. Governing Law
